Many Ohio Towns Will Ban Recreational Marijuana Despite Legalization


In November 2023, Ohioans made a historic decision by voting to legalize recreational marijuana, making Ohio the 24th state to approve adult-use cannabis. While this marked a significant milestone, the road to implementing recreational sales has been fraught with challenges. 


Many Ohio towns have chosen to ban or pause the sale of recreational marijuana, resulting in delays that have left residents with limited access. Ohio's Journey to Legalization

In 2016, Ohio voters legalized medical marijuana, and by 2019, dispensaries began opening across the state. The successful medical marijuana program laid the groundwork for the push towards recreational legalization. 


When voters approved the ballot measure for adult-use marijuana in November 2023, it was clear that the journey was far from over. The new law allowed Ohioans over 21 to legally grow and possess marijuana at home immediately, but the establishment of recreational dispensaries has been slower to materialize.


Local Bans and Moratoriums

Despite the statewide legalization, many Ohio towns and cities have opted to ban or place moratoriums on recreational marijuana sales. As of June 2024, 56 municipalities have enacted moratoriums, according to the Drug Enforcement and Policy Center at Ohio State University's Moritz College of Law. These bans and pauses are creating a patchwork of regulations that vary significantly from one community to another.


Notable Bans and Moratoriums:

  • Avon: Passed a ban on recreational marijuana dispensaries in April 2024.

  • Avon Lake: Enacted a ban in May 2024.

  • North Olmsted: Instituted a ban in December 2023.

  • Strongsville: Banned recreational sales in March 2024.

  • Westlake: Approved a ban in April 2024.


Other towns, such as Broadview Heights, Green, Copley Township, Hudson, Orange Village, Twinsburg, and Chardon, have passed moratoriums that temporarily halt marijuana sales and cultivation facilities. These moratoriums are typically in effect until the end of the year, with some towns reevaluating their stance as the statewide program develops.


Lakewood stands out as a city that recently lifted its moratorium, allowing for recreational sales as soon as its medical dispensaries receive dual-use permits. This decision reflects the high level of voter support for legalization in Lakewood, where nearly 80% of residents approved Issue 2. Lakewood City Council President Sarah Kepple emphasized the city's commitment to thoughtful and safe implementation of the new law, responding to the voters' choice.


The Delays in Recreational Sales

One of the primary reasons for the local bans and moratoriums is the desire to regulate and control the rollout of recreational marijuana carefully. Cities and towns are concerned about the potential impact on their communities, including public safety, zoning issues, and the need for a robust regulatory framework.


The Ohio Department of Commerce's Division of Cannabis Control is responsible for issuing licenses for recreational sales. However, as of now, the timeline for when the first permits will be approved remains unclear. 


James Crawford, the public information officer for the Ohio Department of Commerce, indicated that the issuance of licenses will depend on various factors, including staffing and stock availability at dispensaries. This uncertainty has contributed to the cautious approach taken by many municipalities.
