The Ohio Medical Marijuana Control Program (OMMCP) has announced new regulations in an attempt to get a handle on a recently popular product out there called delta-8 THC. There are new testing, notification and labeling requirements, but they only apply to products sold in licensed Ohio dispensaries.

Is Delta-8 THC Legal in Ohio?
Delta-8 THC is derived from hemp, which some argue makes it just as legal to sell as CBD. While it’s true that you can often find delta-8 THC products at your local Circle K, the legality of its production is questionable, and regulation outside of the Ohio Medical Marijuana Control Program is scant.
Is the Delta-8 THC at the Convenience Store Safe?
You can still get unregulated products in a retail setting, like at convenience stores and specialty shops, but your safest bet is always to make your purchases at an Ohio dispensary. There, you’ll find a variety of legal medical marijuana products that are tested and regulated.
When Will the OMMCP’s New Regulation Go Into Effect?
It’s unclear when and how the new regulations set forth by the OMMCP will go into effect, but they will require producers to register their delta-9 THC products with the program, sharing their standard operating procedures and ensuring compliance.
The presence of delta-8 THC will contribute to the overall cap on THC percentage already in place. Products have a total concentration of no more than 70 percent THC, and this includes both delta-8 and delta-9 THC.
Medical marijuana products will be tested for delta-8 THC, and all products that contain it will be required to clearly indicate its presence on their labels.
