Ohio Republicans Introduce a Proposal to Change the State’s Recreational Marijuana Laws

Just months after Ohio’s recreational marijuana dispensaries began serving customers on August 6, 2024, state Republicans are introducing significant changes to Ohio’s marijuana landscape. Representative Brian Stewart (R-Ashville) has unveiled Ohio House Bill 160 (HB 160), proposing amendments that could impact both recreational consumers and medical marijuana patients statewide.


What Changes Are Ohio Republicans Proposing?

Ohio voters passed Issue 2 in November 2023, legalizing recreational marijuana with overwhelming support. However, due to the initiative passing as a citizen-led effort, Ohio lawmakers retain the authority to modify its provisions. Recently, Republicans in both the House and Senate have proposed changes to the existing marijuana laws.


HB 160, introduced by Rep. Stewart, closely mirrors the Senate’s recently passed Senate Bill 56 but has some distinct differences:


  • THC Potency Limits: HB 160 would cap THC potency at 70% for marijuana concentrates, down from the current maximum of 90%. Additionally, plant-based marijuana products would be capped at 35% potency. Stewart argues these limits will increase consumer safety, particularly for younger Ohioans.

  • Dispensary Cap: The proposal also includes limiting the number of active dispensaries statewide to 350. Ohio's recreational marijuana market is relatively new, and lawmakers aim to prevent oversaturation while carefully controlling the industry's growth.

  • Taxation and Revenue Distribution: Unlike previous proposals by other Republican legislators, HB 160 maintains the current 10% recreational marijuana excise tax. However, the bill proposes redirecting the majority of marijuana tax revenue to Ohio’s general fund, significantly altering the current distribution strategy.

  • Public Consumption: Under HB 160, marijuana consumption would remain prohibited in public spaces but explicitly allows smoking marijuana on privately-owned residential properties, including front porches and yards.

  • Intoxicating Hemp Regulation: Another key aspect of HB 160 addresses delta-8 THC and similar intoxicating hemp products. The bill mandates that these products be regulated like marijuana and sold exclusively in licensed dispensaries, addressing longstanding regulatory gaps.


Ohio’s Marijuana Legalization and Lawmaker Intervention

Ohio’s recreational marijuana market opened on August 6, 2024, but not all dispensaries participate in recreational sales. Only those with dual-use licenses, allowing both medical and recreational sales, can serve recreational customers. This nuance creates a more limited recreational marijuana environment than some voters initially anticipated.


Ohio lawmakers have long maintained their right to adjust voter-passed marijuana legislation, and HB 160 is the latest example of legislative adjustments. Rep. Stewart asserts that the changes are minimal, focusing primarily on maintaining consumer safety and improving regulatory clarity.


“We're preserving the core of Issue 2 but adding important protections,” Stewart noted during his announcement. This careful approach is designed to maintain broad voter support while addressing Republican concerns around marijuana safety and regulation.


Impact on Marijuana Consumers and Industry

The proposed changes could have significant implications for both consumers and businesses in Ohio’s marijuana market. Limiting THC potency and capping dispensary numbers may impact product availability and variety, potentially driving some consumers to seek marijuana products outside legal channels.


Adrienne Robbins, Deputy Executive Director of the Ohio Cannabis Coalition, offered cautious optimism, noting HB 160 represents a positive step compared to prior proposals, though expressing concerns about the proposed THC potency caps. "We don’t think this is necessarily a potency argument, but a purity one," Robbins explained, emphasizing concerns that lower potency products might lead to unwanted additives or reduced effectiveness.


Moreover, the bill's adjustments to revenue distribution could substantially impact municipalities that currently rely on marijuana tax funds for community projects and local improvements.


A Legislative Tug-of-War

The introduction of HB 160 comes shortly after Ohio’s Senate passed Senate Bill 56, a similar but stricter proposal. SB 56 aims to reduce home cultivation limits from 12 to 6 plants, impose THC potency caps, and mandate marijuana transport only in car trunks. SB 56 also restricts marijuana use strictly to indoor private residences.


Though HB 160 shares many features with the Senate proposal, such as potency caps, it preserves more elements of the original voter-approved legislation, notably keeping home cultivation at the existing 12-plant limit.


With two competing marijuana bills in the legislature, Ohio Republicans face the challenge of aligning their goals and reaching a consensus before legislation reaches Governor Mike DeWine’s desk.
